Embattled Trump-endorsed Congressman Max Miller is facing a lawsuit by his ex-wife for allegedly uploading a nude photo of the couple’s toddler. 

Emily Moreno, 32, the daughter of Ohio Senator Bernie Moreno, has accused Miller, 37, of domestic violence and drug abuse after the Daily Mail first reported the allegations in May. Miller has denied all the claims against him.

The lawsuit claims Miller provided nude photos of his daughter, 2, to his attorney, Aaron Minc, to publish alongside information used to discredit Moreno’s accusations of abuse. 

The federal civil-rights complaint was filed Wednesday in Ohio by Moreno on behalf of the two-year-old, naming Miller, Minc and the firm Minc LLC as defendants.

According to the suit, the image was buried in a Dropbox folder Miller linked from his X account on August 2, hours after a livestream in which he set out to defend himself against Moreno’s abuse claims.

Moreno’s lawyers say the posts pointing followers to that folder drew more than 400,000 views and interactions before the file came down.

The photograph had originally been taken as part of an inquiry into an injury the toddler sustained to her collarbone. 

The filing accuses both men of breaching state and federal law, citing the statute covering non-consensual disclosure of intimate images, invasion of privacy, negligence and civil conspiracy.

Miller, who has denied all wrongdoing, has refused to resign from Congress or drop his re-election bid. He was endorsed by President Donald Trump, his former boss, in May

Damages are pegged at $150,000 for every instance the image was accessed, transferred, distributed or downloaded.

Minc previously admitted to accidentally publishing a document which contained a nude photograph of the two-year-old and apologized for the mistake.

The Daily Mail was first to reveal the abuse accusations in May, which include a claim that he threw hot water on his ex-wife.

The House Ethics Committee has now formally opened an investigation into the domestic violence and drug abuse accusations as he demanded to clear his name. Miller himself called for the investigation into the allegations.

In a gambit to clear his name from the nasty allegations lobbed at him, Miller also released a trove of files two weeks ago.

Among them are audio recordings of him arguing with his ex-wife over the syringes she claims to have found near his bed.

‘I have gone into your backpack because I truly do believe you have a drug problem,’ Emily said in one of the audio tapes.

A defiant Miller shot back: ‘Okay, what drugs?’

‘First it was weed, then I found needles next to your bed,’ Moreno told Miller, according to the recording. ‘I took a picture of it. You can try to deny it to me.’

Miller repeatedly denied any drug use during the back and forth, promising so to his ex-wife by invoking his ‘Jewish word of honor.’

Pressed by CNN host Jake Tapper this week on the last time he had illegal drugs, Miller responded that it was years ago, though exactly when, he said, he was unsure.
