An intoxicated Long Island mother crashed her car with both her young children inside on the same day she posted photos of herself day-drinking, police said. 

Jesher Rivera-Barreto, 31, was driving a 2006 Toyota 4Runner on Saturday evening with her one-year-old and four-year-old children in the car. 

Around 11.25pm, she lost control of the vehicle because she was drunk, left the road and crashed into the woods, according to the Suffolk County Police Department. 

The mother and both children were transported to a hospital, where Rivera-Barreto and her one-year-old were treated for minor injuries. The four-year-old was unharmed. Both children were released to their father at the hospital.

Rivera-Barreto was arrested and charged with aggravated driving while intoxicated with a child passenger less than 15 years old, driving while intoxicated and two counts of endangering the welfare of a child.

The mother, who is highly active on social media, had posted photos of herself drinking an espresso martini on Saturday afternoon.

She posted the pictures on her Facebook and Instagram accounts with the same caption that said, ‘Little joys,’ along with a coffee cup emoji. The Facebook post was timestamped at 1.58pm.

It appears that Rivera-Barreto was getting an early start with the day-drinking, as police said she was intoxicated during the crash about nine and a half hours later.

Rivera-Barreto is the mother of a one-year-old and a four-year-old. The one-year-old suffered minor injuries, and the four-year-old, whom she is pictured with, was unharmed 

The Suffolk County Police Department said it was holding the mother in jail overnight. 

Her arraignment took place on Monday, though it is unclear whether she pleaded guilty or not guilty.

Rivera-Barreto’s charge of aggravated driving while intoxicated with a child passenger less than 15 years old is also known as Leandra’s Law, a New York state law passed in 2009 that makes it an automatic felony to drive while intoxicated with a passenger under 15.

The law was enacted after 11-year-old Leandra Rosado was killed when her friend’s mother was driving drunk and flipped a car on the highway. 

Six other children in the car were also injured, and the driver was sentenced to four to 12 years in prison. She had initially only been facing misdemeanors, as there were previously no felonies prosecutors could charge her with.

If Rivera-Barreto is convicted on the Leandra’s Law charge, she faces up to four years in prison and a fine of up to $5,000. 

She would also have to have an ignition interlock device, which is a breathalyzer test required to start an engine, installed in her vehicle. 

If the mother’s children had been more seriously injured or killed, she would be facing a potential sentence of up to 15 to 25 years in prison. 

Rivera-Barreto was charged with two counts of endangering the welfare of a child, driving while intoxicated and Leandra’s Law, a felony charge for drunk driving with child passengers 

The mother faces up to four years in prison and a fine of up to $5,000 for her felony charge, as well as up to one year in jail and fines of up to $1,000 for her other charges

Rivera-Barreto’s other charges of Driving While Intoxicated and Endangering the Welfare of a Child are both misdemeanors. 

If convicted, she faces up to one year in jail and fines of up to $1,000 for each charge.
