Your offer for that new executive role looks fantastic but have you looked at the fine print yet for any non-compete or non-solicitation clauses yet? Those could be a huge headache for you. Let me explain why. I’m Jeff Altman, The Big Game Hunter. A non-compete that prevents you from working in your industry, geography, or any vaguely related company for a year or two can sideline your career after an exit at the C-level. That basically translates into losing momentum and networking leverage. If you’re in the situation where they’re trying to push for that, some form of non-compete is standard, especially for executives, but what matters is the language is reasonable and enforceable in your jurisdiction.
You can usually negotiate it down to a specific something or other, a specific period of time: six months, maybe 12 at the outside, not 24, because that’ll really destroy your situation. Having worked with someone in the past who is not at an executive level, who is at a D level, you know, it really was a headache for him to join his next organization. He had to stay out of work for a year, and he was a D, he wasn’t a C-suite guy like you.
The result wound up being yes, his old firm had to pay him a little something to make it enforceable, but it wasn’t his income. You don’t want to be in that situation. You want to make sure you negotiate down any sort of non-compete, any sort of non-solicitation agreement from something extremely broad to something specific.
