Legal matters between Halle Berry and her ex-husband, Olivier Martinez, are reportedly getting even more serious. And let’s just say… a recent court filing brings their co-parenting situation back into the spotlight.

Olivier Martinez Seeks Sole Custody Of Son Maceo

According to court documents and reports, Halle Berry’s ex-husband, Olivier Martinez, has been granted temporary custody of their 12-year-old son, Maceo, following his allegations that Berry choked the child during a Sept. 26 incident. The temporary restraining order was reportedly granted on Thursday, changing the former couple’s previous 50/50 custody arrangement.

Under the new order, Berry will reportedly have daytime visits with Maceo two days a week and every other weekend. Moreover, she has also been ordered to stay at least 100 yards away from Martinez. The pair is scheduled to return to court on Oct. 16

Martinez Details Alleged Incidents Involving Berry & Son

Martinez reportedly told the court that the Sept. 26 incident was not the first alleged incident involving Maceo. In the filing, he claimed there had been other alleged physical attacks against their son, as well as verbal and emotional abuse directed toward him over the past several years. His attorney told PEOPLE that their “paramount concern” is the child’s health and welfare. Berry’s representatives did not immediately respond to PEOPLE’s request for comment.

According to Martinez’s filing, Maceo allegedly called his father after the Sept. 26 incident and asked him to pick him up, claiming Berry had physically attacked him. Martinez further alleged that Berry’s fiancé, Van Hunt, was present and defended Maceo during the reported confrontation. Martinez also included alleged text exchanges between himself and Berry regarding the situation, including a message in which she reportedly said that Maceo was being disrespectful and that she felt she had no say in his life.

Halle Berry Fires Back Through Her Attorney

Berry has denied Martinez’s allegations through her attorney, Marina Beck, who called his filing “entirely meritless and deliberately misleading.” Beck also alleged that Martinez has repeatedly violated court orders and interfered with therapeutic and educational interventions for Maceo, adding that he has previously faced legal sanctions related to his conduct. Berry’s attorney further accused Martinez of having a history of “erratic, possessive and violent behavior,” while saying Berry remains focused on what she believes is in Maceo’s best interests.

Berry And Martinez’s Co-Parenting History Resurfaces

The latest allegations come amid a long-running co-parenting dispute between Berry and Martinez. The former couple, who married in 2013 and split in 2015, finalized their divorce in 2023 after years of custody-related proceedings. They had previously agreed to joint legal custody of Maceo, and in 2024, court documents showed that they agreed to participate in co-parenting therapy to help resolve conflicts between them.
